TO THE AMERICAN PEOPLE

AN OPEN LETTER FROM THE VIETNAM ASSOCIATION FOR VICTIMS OF AGENT ORANGE/DIOXIN

Hanoi, 6 Aug, 2004

Dear American friends,

With sincere and friendly sentiments, from a far-away land of the West Pacific Ocean, we would like to send this letter to all of you. It is written on the pending day of August 10th, when the U.S aircrafts, in 1961, began the spraying of herbicides in Vietnam with the northern areas of Kontum as their first target.

The most recent investigative study conducted by American scientists reported in the April 2003 issue of Nature Journal has discovered that U.S forces, from 1961 to 1971 deployed about 80 million liters of toxic chemicals, more than half of which was agent orange containing nearly 400 kilograms of dioxin, an extremely dangerous substance, to destroy our environment and human health. This horrible outcome was right from that time in 1960s, confirmed, warned and opposed by many prestigious American and world researchers such as Professor Arthur Galston, a biologist at together with the U.S Physiobotanist Association and about five thousands (5,000) other U.S scientists, including seventeen (17) Nobel laureates and one hundred and twenty nine (129) members of the U.S National Academy of Sciences.

Dear friends,

From the Bertrand Russell Tribunal of Conscience held during the time of the Vietnam War to the Stockholm Conference convened in July 2002, and to now, the support offered by the progressive people all over the world has greatly inspired the Vietnamese people to overcome uncountable difficulties and sufferings in the course of their fight for their national reunification and reconstruction.

The war is over. The country has made her marvelous rebirth. Millions of people have nevertheless been subject to deadly incurable diseases due to dioxin exposure. Thousands of them have consequently died in agony with deep indignation towards the perpetrators of crimes. Many women have suffered reproductive complications and even the total loss of the right to be a mother. Among other things, the most painful fact may be that their descendants who have nothing to do with the war were, are and will be, as victims of dioxin, born with inherited diseases, and, of course, without smallest hope of enjoying even a minute of happiness of living like an ordinary being. The victims of Agent Orange/dioxin are the most miserable and tragic people. Many of them, with lots of deformed off-spring, have almost survived in poverty.

We, the Vietnamese people, ceaselessly thirsty for peace and friendship, have exerted great patience in demonstrating our preparedness for cooperation with the U.S in solving the cruel war consequences, especially those severe evils resulting from horrible chemical warfare. However, this has met no positive response. In face of this situation, the Vietnamese victims of Agent Orange feel it necessary to file a lawsuit against the U.S chemical corporations, the suppliers of this toxic substance used in the Vietnam War and who gained enormous profits from the sufferings of millions of people.

The legal action taken by the Vietnamese victims is also designed in the lawful interests of all other victims, including those in the United States, Australia, the Republic of Korea, Thailand, New Zealand and the Republic of Philippines. Inevitably, this legal action is structured for the sake of many forthcoming generations. It is nevertheless undertaken for the solemn right-to-life of every human being.

Dear friends,

We hereby would like again to affirm that the Vietnamese have never harbored any sense of hatred for the American people who have written several important pages of history of hard struggle for independence and freedom. We are earnestly hoping to enjoy your further understanding and more profound sympathy for the extreme sufferings imposed on the Vietnamese victims. However, we would like you to know that the use of toxic chemicals is totally in brazen violation of international laws and thus being a war crime and an act of betrayal against the spirit of the Declaration of Independence by Thomas Jefferson.

For the sake of justice and noble conscience, please raise your voice and demand the U.S Court of Law to conduct serious litigation proceedings, and that the U.S chemical corporations to fulfill their compensation liability for the victims of Vietnam, of the United States and of other countries. The present struggle is directly aimed at the peaceful and happy life of our future generations on this planet.

Các bạn Mỹ thân mến

Với tình cảm chân thành và thân thiện, từ mảnh đất xa xôi phía tây Thái Bình Dương, chúng tôi muốn gửi bức thư này đến tất cả các bạn. Bức thư được viết trước ngày 10.8, ngày mà máy bay Mỹ - hồi năm 1961, bắt đầu phun chất diệt cỏ xuống Việt Nam, các vùng đất phía bắc tỉnh Kon Tum là mục tiêu đầu tiên của họ.

Các nghiên cứu điều tra gần đây nhất của các nhà khoa học Mỹ công bố trên tạp chí Nature tháng 4.2003 đã phát hiện ra rằng, từ năm 1961 đến 1971, lực lượng Mỹ đã rải 80 triệu lít chất độc hoá học xuống Việt Nam, hơn một nửa trong số đó là chất da cam chứa gần 400kg dioxin - một chất cực nguy hiểm, để phá hoại môi trường và sức khỏe con người. Hậu quả đáng sợ này đã đúng từ thời những năm 1960, đã được khẳng định, cảnh báo và phản đối bởi nhiều nhà nghiên cứu rất uy tín người Mỹ và trên thế giới như Giáo sư Arthur Galston - nhà sinh vật học thuộc U.S Physiobotanist Association và khoảng 5.000 nhà khoa học Mỹ khác, trong đó có 17 người được giải Nobel và 129 thành viên của Viện Hàn lâm Khoa học quốc gia Mỹ.

Các bạn thân mến,

Từ Toà án lương tâm Bertrand Russell (Bertrand Russell Tribunal of Conscience) diễn ra trong thời gian chiến tranh ở Việt Nam cho tới Hội nghị Stockholm tháng 7.2002, và cho đến nay, sự ủng hộ của nhân dân tiến bộ trên toàn thế giới đã truyền cảm hứng cho nhân dân Việt Nam vượt qua vô vàn khó khăn gian khổ trong cuộc chiến đấu thống nhất và xây dựng đất nước. Chiến tranh đã qua. Việt Nam đã tái sinh một cách đáng kinh ngạc. Nhưng hàng triệu người dân vẫn chịu hậu quả từ những căn bệnh gây chết người và không thể cứu chữa được do phơi nhiễm dioxin. Hàng nghìn người đã chết trong đau đớn và nỗi căm phẫn đối với những kẻ đã gây tội ác. Nhiều phụ nữ đã chịu biến chứng khi sinh nở và thậm chí hoàn toàn mất quyền làm mẹ. Trong đó, điều đau xót nhất là con cái họ, những người không bao giờ biết đến chiến tranh, đã, đang và sẽ là nạn nhân của dioxin, sinh ra với những bệnh di truyền và tất nhiên, không có hy vọng nhỏ nhoi được hưởng niềm hạnh phúc được sống dù chỉ là một phút như một người bình thường...

Chúng tôi, người dân Việt Nam, chưa bao giờ ngừng khao khát hoà bình và hữu nghị, đã rất kiên nhẫn khi thể hiện sự sẵn sàng hợp tác với Mỹ để giải quyết các hậu quả của cuộc chiến tranh tàn khốc, đặc biệt là những hậu quả nghiêm trọng do cuộc chiến tranh hoá học kinh khủng gây nên. Tuy nhiên, điều này vẫn không được hưởng ứng tích cực. Vì vậy, Hội Nạn nhân chất độc da cam cảm thấy cần thiết phải kiện ra toà các công ty hoá chất Mỹ - các nhà cung cấp chất độc sử dụng trong chiến tranh ở Việt Nam, những người đã thu được lợi nhuận khổng lồ từ nỗi đau của hàng triệu con người.

Vụ kiện của các nạn nhân Việt Nam cũng được tiến hành trên lợi ích hợp pháp của tất cả các nạn nhân khác, kể cả những người ở Mỹ, Australia, Hàn Quốc, Thái Lan, New Zealand và Philippines. Chắc hẳn vụ kiện này cũng còn vì lợi ích của các thế hệ tiếp theo nữa. Vụ kiện được tiến hành vì quyền được sống rất đáng trân trọng của mỗi con người.

Các bạn thân mến, chúng tôi một lần nữa, muốn khẳng định với các bạn rằng, người Việt Nam không bao giờ mang tình cảm thù ghét với nhân dân Mỹ, những người đã viết nên những trang sử đấu tranh vì độc lập và tự do cực kỳ quan trọng. Chúng tôi thành thật hy vọng có được sự thấu hiểu và thông cảm từ các bạn với những nỗi đau tột cùng mà các nạn nhân Việt Nam phải chịu. Tuy nhiên, chúng tôi mong các bạn biết rằng, việc sử dụng các chất độc hoá học là hoàn toàn vi phạm luật pháp quốc tế và vì vậy đây là một tội ác chiến tranh, một hành động phản bội lại tinh thần của Tuyên ngôn Độc lập do Tổng thống Thomas Jefferson viết ra.

Vì công lý và lương tâm cao thượng, xin các bạn hãy lên tiếng và yêu cầu Toà án Mỹ tiến hành các thủ tục pháp lý quan trọng, các tập đoàn hoá chất Mỹ thực hiện trách nhiệm bồi thường của họ với các nạn nhân Việt Nam, Mỹ và nạn nhân các nước khác. Cuộc đấu tranh này là vì cuộc sống hoà bình, hạnh phúc của các thế hệ tương lai trên hành tinh chúng ta.
